Have been practicing personal injury litigation for 30 years and know very little patient law,but I do have a handle on the following I think:
1.Joint motion for stay.
To me it was important that the lawyers for PTSC/TPL presented the motion and order to the Court. Shows whos in control. My belief there was a phone call between the Attorneys and Judge prior to the Order being entered,the judge understood the need for the stay and said prepare the order. No need to stir the stock market on a sell off of any stock or purchase of any stock by putting the reason for the stay.
2. Remember a Federal Judge in the legal system is God. He is appointed for life. His rulings are seldom questioned. Its his ship and the authority is not questioned.
3.Web cam cancelled
To me if JT had went forward, he might have violated the stay.Its clear that either the attorneys or TPL said no.HIs web cast caught the investors by surprise, and apparently others.
4. Is it settled?
My opinion is Yes nearly.When the phone call was made to the Court,a settlement in theory was announced ,the details just had to be worked out. Lawyers did not want publlic pressure to influence either side in working out the details, therefore 30 day Stay.
One of the J3 might have been kicking but if the other two settled, he had to settle and details worked out.
The Judge would not have granted the stay if settlement had not been anounced to him. No Numbers given, thats what is being worked out.You will notice the pressure is still on all parties in that the trial date was not changed or mentioned...
5.When will we hear?
Within the 30 day time period and when those that are authorized by each Board of each company signs the settlement agreement.
Was wondering if PTSCs board had authorized JT to sign or does the Board have to be called and authorize JT and secretary to sign. With the agreement that TPL runs the show, Does PTSC do what ever TPL says to do with out question and can Tpl settle the case without PTSCs board approval????Probably.
Just a few thoughts
Auch wenn er in einem anderen Bereich tätig ist, kann dieser Agora-Poster solche Vorgänge natürlich sehr gut deuten, denn Vergleiche vor Gericht laufen fast immer nach dem gleichen Schema ab.
Also warten wir fröhlich auf die entscheidende PR.....hehehe, auch wenn es heute wieder weiter runter geht.

Nun wenn die den Prozess für 30 Tage aussetzen lassen, dann kann man schon sagen, dass sich in Texas einiges tut:
Ach wenn TPL die gewissermaßen aktive Rolle in den Verhandlungen mit den J2-3 übernommen hat, so denke ich hat die
Geschäftsführung von PTSC da trotzdem ein Wörtchen mitzureden. Mehr noch, wenn man überlegt ob
man sich außergerichtlich einigt, damit den Prozess beendet.
Aber all das sind Spekulationen, vielleicht grassiert da einfach nur ´ne Grippe und alle liegen krank im Bett und deshalb wurden die Termine abgesagt.
In ein paar Wochen sind wir schlauer.

Es ist nicht ganz einfach, eine solche Firma zu übernehmen: Die Aktionärsstruktur bei PTSC sind viele, viele Kleinanleger…
Man müsste entweder die Aktien auf dem freien Markt einsammeln, oder den Aktionären ein entsprechendes Angebot machen.
Sagen wir es würde zu einem solchen Angebot kommen, dann müsste das schon mal gleich eine Milliarde sein, sonst wäre es wenig erfolgversprechend. Eine Milliarde legt man allerdings nur an, wenn es sich um eine sichere Sache handelt, sprich die Rendite müsste bei diesem Risiko mindestens 10-15 % betragen. PTSC müsste also einen Gewinn von mindestens 100 Mio. pro Jahr erwirtschaften und ein Wiederverkauf möglich sein.
…deshalb kann ich mir das nicht vorstellen. Aber wie Du schreibst, möglich ist alles.

Remember how the defense was upset because Roger Cook and company were asking for Sales documents and design schematics going "decades" back (to use the exact word defendants used)?
Remember how the defense was upset because Roger wouldn't "tell" the the Amount of money he wanted for settlement?
Remember how Roger said he couldn't accurately come up with a "number" until he received all the Sales documents and design schematics going "decades" back?
And for those who have looked at the TT&C web site:
Remember how it was Roger Cook that got a $1.5 BILLION dollar settlement against Microsoft in a class action law suit?
Remember how David Pohl (or was it JT) said that the MMP was like WATER?
So, considering all the above that we DO know, IMO Roger Cook and company are not going to settle for a small amount of money at this point.
IMO..........No Way. From the TT&C web site:
Over the past eight years, Mr. Cook successfully defended more than eight major patent infringement lawsuits involving semiconductor device and process technology, involving more than 35 different patents and aggregate royalty damages claims exceeding several billion dollars. Four of these cases were in so-called "rocket docket" jurisdictions where the cases go to trial within about eight months from filing.
Just using the above numbers of 2 Billion divided by 8 cases and you get $250 Million dollars per company.
Roger has called "our" case "A Patent Litagators Dream".......OUR Case, not the 8 cases listed above.
Just connecting the dots here. Of course I will be very happy to hear the words WE Settled.........but I agree with Milestone that at this point and considering all of the above...........we are NOT settling for just a little more than we got from Fujitsu 2 years ago.
Also of importance for those that don't realize it, Roger Cook is the one who set up the First Mover Discount program.........not TPL.
There is a "strategy" at play here and Roger Cook is, at this point in time, not going to "give" the J's a nice big discount. Two years TOO late. IMHO.

Gericht kann keinen Schaden erkennen
Ein kalifornisches Gericht hat die Klage von Apple-Aktionären wegen einer Rückdatierung von Aktienoptionen als unbegründet zurückgewiesen. Eine New Yorker Pensionskasse hatte in der Klageschrift behauptet, dass Aktionäre durch die Rückdatierung von Aktienoptionen in den letzten zwölf Monaten Schaden erlitten hätten.
Doch der Richter warf nur einen kurzen Blick auf den Verlauf der Apple-Aktie in dem besagten Zeitraum und sagte daraufhin kurz und knapp: "Tut mir Leid, aber der Aktienkurs hat sich im letzten Jahr verdoppelt: Ich kann hier nicht den geringsten Schaden feststellen."
Die Kläger können noch einen Anlauf unternehmen, indem sie behaupten, dass nicht die Aktionäre, sondern Apple als Ganzes Schaden genommen habe - aber auch das müssten sie dann gemeinsam mit anderen Klägern beweisen, deren Verfahren noch anhängig sind. Hierzu gehört insbesondere die Klage der Börsenaufsicht SEC gegen Apples Chefanwältin Nancy Heinen. Zu diesem Fall war Apple-Chef Steve Jobs bereits mehrmals vorgeladen worden.
