Ambac Assurance Corp. sued Bank of America Corp. over $16.7 billion of mortgage-backed securities, saying the bank’s Countrywide Financial Corp. fraudulently induced Ambac to insure the bonds.
Ambac found that 97 percent of 6,533 home mortgage loans it reviewed across the 12 securitizations sponsored by Countrywide didn’t conform to the lender’s underwriting guidelines, according to the complaint filed in New York state Supreme Court. Many of the loans were made to borrowers with limited or no ability to meet their payment obligations, Ambac said.
Ambac has paid hundreds of millions of dollars in claims connected to defaults in the securities, according to the suit filed yesterday. At the same time, Countrywide has refused to comply in a timely fashion with its obligations to repurchase the out-of-guideline loans or bring them into compliance, the lawsuit claims.
Ambac is “entitled to redress for Countrywide’s massive fraud and pervasive and material breaches, including damages sufficient to place Ambac in the same position it would have been in had it never insured the transactions,” the suit says.
Shirley Norton, a spokeswoman for the Charlotte, North Carolina-based lender, said the bank has no comment.
The case arises out of 12 Countrywide-sponsored transactions that closed between 2004 and 2006, nine of which involve home equity lines of credit secured by second-lien mortgages and three that involve fixed amount second-lien loans.
Over the last two years, the loans in the transactions have defaulted at what Ambac calls “extraordinary rates.” To date, the suit claims, more than 35,000 loans with a total principal balance of more than $1.95 billion have defaulted or been charged off. In a filing Tuesday in U.S. Bankruptcy Court in Manhattan, Lehman said it has agreed to a settlement of all claims filed by Ambac, the bond-insurance unit of Ambac Financial Group Inc.
Ambac Assurance, which is undergoing rehabilitation proceedings in Wisconsin, filed 60 claims against Lehman totaling more than $6.1 billion stemming from Lehman's bankruptcy filling. Ambac had issued financial guarantees on residential mortgage securitizations and credit-default swaps involving Lehman mortgage deals.
The deal, which has the backing of Lehman's unsecured creditors, slashes billions from the pool of unsecured claims against Lehman in return for Lehman dropping its claims that Ambac owes it tens of millions of dollars under several disputed Ambac-insured derivatives deals.
While the settlement calls for the mutual release of all claims between Lehman and Ambac, no money changes hands under the deal.
A hearing on the settlement, which requires bankruptcy court approval, is scheduled for Oct. 20.
Because Lehman is barred by a temporary injunction issued by the Wisconsin rehabilitation court from pursuing its claims against Ambac, Lehman said it would likely spend "months if not years" in costly, "highly speculative" litigation, which even if successful "would yield no better result" than the settlement.
Wisconsin's insurance commissioner, Sean Dilweg, said Tuesday he expects to file his rehabilitation plan for Ambac in a state court late this week or early next week. Mr. Dilweg has already set up a segregated account for $68 billion worth of policies that Ambac sold on structured securities, including those at the center of the dispute with Lehman, and temporarily prevented those policyholders from collecting money from the insurer.
In a recent "state of the estate" presentation in bankruptcy court, Lehman said it estimates unsecured claims will ultimately total between $250 billion and $300 billion, down from $860 billion previously forecast.
Lehman's plan to pay back its creditors calls for general unsecured creditors of the main holding company to recover between 10.4% and 14.7% on their claims. Unsecured creditors of some of the company's subsidiaries, including its derivatives arm, are slated to get more.
After Lehman collapsed in September 2008, the company filed the largest Chapter 11 case in U.S. history. Its bankruptcy consists of 23 different entities each with separate Chapter 11 plans, with creditors of each debtor being paid from the assets of that debtor.
Lehman hopes to have a Chapter 11 plan confirmed by early 2011.

du gibst ja sonst immer Einschätzungen ab und beurteilst die Lage, heute nachdem diese News raus gekommen sind und der Kurs maßgeblich partizipieren konnte sagst du garnichts dazu. Hast du eine Meinung dazu oder bist du selber so überrascht, dass du garkein Statement dazu abgibst ?!

Eine Einschätzung wird es von mir dazu jetzt nicht geben, da ich sie vorher hatte. Mit diesen Rückzahlungen muss man aber nicht spekulieren, denn ABK generiert auch so einen Cash Flow bis ins JAhr 2098 aufgrund der alten Verträge. Welche Frima hat bitte feste Einnahmen bis 2098?
Diese Rückzahlungen sind der warme Regen, der irgendwann kommen musste, aber ABK hat auch so den Turnaround geschafft, sagte sogar DJNews - kann man hier bei Ariva unter News nachschlagen.
Wer will soll ABK kaufen, wer nicht will soll es sein lassen.
Mit einer Aktie geht man immer unternehmerisches Risiko ein. Jetzt läuft es halt mit einen warmen Regen für ABK in dem sie einen Großteil der vorher gezahlten Gelder zurückbekommen. Ich sagte bereits am Anfang das es so kommen wird, irgendwann und anscheinend jetzt, am Ende sollte ABK fast so gut wie 2006 mit ca. 6 Mrd Eigenkapital da stehen. Bis dahin ist aber noch ein Weg zu gehen. Die Firma hat nur einen Kursreset mit jetzt ca. 302 Mio Aktien anstatt 102 (2006). Cash war nie ein Problem, sagte ABK Ende 2007. Vielleicht sollte man auch mal ein wenig auf seinen Vorstand vertrauen.
57 Mio Aktien bei ca. 6 Mio Durchschnitt die Gestern gehandelt wurden, bei ca. 32% Preissteigerung sollten für sich selbst sprechen.
