NeoMedia Technologies, Inc. (OTC BB: NEOM), the pioneer in global mobile barcode management solutions, today announced that the European Patent Office (EPO) has overturned on appeal the earlier revocation of its European Patent No. 0832453. This patent, entitled SYSTEM FOR USING ARTICLE OF COMMERCE TO ACCESS REMOTE COMPUTER, corresponds to NeoMedia’s United States Patents Nos. 6,199,048; 5,978,773; 7,383,209; 7,765,126; and 8,131,597.
Now that the revocation has been overturned, the EP patent continues to provide NeoMedia with patent coverage across Europe commensurate with these United States patents. The EP patent is registered in UK, Sweden, Austria, France, Italy, Germany and Switzerland.
The EP patent had been revoked, on purely formal grounds, during an opposition instituted by five different opponents. Following appeal by NeoMedia the EPO Board of Appeal overturned that decision and has remitted the case to the EPO Opposition Division for resolution of remaining issues. Prior to the original opposition hearing, the EPO issued a preliminary opinion commenting in NeoMedia’s favor on the issues of novelty and inventive step, and there is therefore now reason to expect that the outcome will be maintenance of the patent.
