Eleventh Circuit Court of Appeals Rules in Favor of Mesa Air Group - Affirms Preliminary Injunction Against Delta Air Lines
Eleventh Circuit Court of Appeals Rules in Favor of Mesa Air Group - Affirms Preliminary Injunction Against Delta Air Lines
PHOENIX, July 2 /PRNewswire-FirstCall/ -- Mesa Air Group, Inc. (Nasdaq: MESA) (the 'Company') announced today that the U.S. Court of Appeals for the 11th Circuit has affirmed the preliminary injunction against Delta Air Lines ('Delta'), which enjoined Delta from terminating Freedom Airlines' Delta Connection Agreement covering certain ERJ-145 aircraft (the 'Agreement').

(Logo: http://www.newscom.com/cgi-bin/prnh/19990210/LAW065)

On May 29, 2008 the United States District Court for the Northern District of Georgia issued a preliminary injunction against Delta enjoining it from terminating the Agreement in place between Freedom Airlines and Delta. Delta had sought to terminate the Agreement based upon allegations that Freedom had failed to meet certain operational performance requirements. In affirming the District Court's decision, the Court of Appeals noted that Freedom had shown a substantial likelihood of success on its claims and that the District Court found testimony of Delta's primary witness to be 'non-credible.' The Order granting a preliminary injunction included the finding that Delta acted in 'bad faith' in its attempt to terminate the Agreement. The preliminary injunction will remain in place while the case proceeds in the District Court. With both the District Court and now the Court of Appeals finding that Mesa has demonstrated a substantial likelihood of success on its claims, Mesa looks forward to having this matter fully and finally resolved at trial.

Commenting on today's ruling, Mesa Chairman and CEO, Jonathan Ornstein said, 'We are very pleased with the Court's Order affirming the injunction issued by the District Court. We reaffirm our commitment to offering the very best service to Delta and our Delta Connection passengers. We would also like to thank our dedicated employees who have continued to provide outstanding service through this unfortunate case.'

Freedom Airlines currently operates 22 50-seat ERJ-145 aircraft for Delta as Delta Connection.

Mesa currently operates 150 aircraft with approximately 800 daily system departures to 110 cities, 38 states, the District of Columbia, Canada, and Mexico. Mesa operates as Delta Connection, US Airways Express and United Express under contractual agreements with Delta Air Lines, US Airways and United Airlines, respectively, and independently as Mesa Airlines and go!. In June 2006 Mesa launched inter-island Hawaiian service as go!. This operation links Honolulu to the neighbor island airports of Hilo, Kahului, Kona and Lihue. The Company, founded by Larry and Janie Risley in New Mexico in 1982, has approximately 3,700 employees and was awarded Regional Airline of the Year by Air Transport World magazine in 1992 and 2005.

Go! filled 71 percent of planes in June
By David Segal

POSTED: 01:30 a.m. HST, Jul 03, 2009

Mesa Air Group's interisland carrier go! filled 71.1 percent of its capacity last month — a year-over-year increase of 2.5 percentage points — due to flying fewer aircraft than it did in June 2008.
The 3-year-old airline said yesterday its load factor increased from 68.65 percent a year ago because it is now near normal capacity with four 50-seat CRJ-200s flying full lines and its fifth aircraft being used half the time for flights and the other half of the time as a spare.
A year ago, go! was operating with seven aircraft — one of the planes was a spare — after adding capacity in the aftermath of the shutdown of Aloha Airlines at the end of March.
Due to the reduction in aircraft, go!'s passenger traffic fell 21.9 percent to 67,150 last month compared with 86,021 in the year-earlier period.
"We are very pleased to have achieved a higher year-over-year load factor in spite of this difficult economic environment," go! Vice President Paul Skellon said. "We continue to carefully match capacity with demand while maintaining high-frequency interisland travel, and we are particularly encouraged by strong bookings over the holidays and the coming months."
Go!'s available seat miles, or one seat transported one mile, fell 25.1 percent to 13.4 million from 17.9 million due to the reduction in aircraft. Revenue passenger miles, or one paying passenger transported one mile, fell 22.4 percent to 9.6 million from 12.3 million.

MESA / Appeals court rules in favor of Mesa Air
by Dawn Gilbertson - Jul. 6, 2009 04:10 PM
The Arizona Republic .
Mesa Air Group has scored another legal victory in its efforts to keep Delta Airlines from canceling its contract with the commuter carrier.

On Thursday, the U.S. Court of Appeals upheld a preliminary injunction issued last spring against Delta. The case centers on Delta's decision to cancel the contract of Mesa subsidiary Freedom Airlines for what it called poor operating performance. Freedom operates as Delta Connection in certain cities with a fleet of 22 50-seat regional jets.

The injunction will be in effect as the case proceeds to trial.
Struggling Mesa, which is based in Phoenix, has a lot riding on the case. Cancellation of the contract would cut off a large source of revenue for the company and leave it searching for a home for the 22 planes at a time when many major airlines are cutting their reliance on regional partners.

Mesa also operates as a feeder carrier for US Airways and United, with a total fleet of 150 aircraft.

Mesa Air reports profits of $1.7M

The parent company of interisland carrier go! airlines posted profits of $1.7 million, or 1 cent per share, for the third quarter, down 5.6 percent compared to income of $1.8 million, or 7 cents per share, during the same period last year.

Revenue dropped by $121.3 million at Mesa Air Group Inc. (Nasdaq: MESA), as a result of a year-over-year decrease in capacity and lower fuel revenue.

The Phoenix-based airline took in $232.6 million in revenues versus $353.9 million for the same quarter last year.

The number of available seat miles was down 10.8 percent for the quarter from 2 million to 1.8 million. The decrease was due to a reduction in the number of aircraft flown from 161 to 142.

Go!, which celebrated its third anniversary, continued to expand its operations and has carried more than 2 million passengers.

Go! reported an operating loss of $4.7 million on revenues of $29.9 million for the first nine months of fiscal 2009, compared to losses of $22.3 million on operating revenues of $29 million during the same period last year.
